Your privacy is important to us. This Privacy Policy outlines how DaySpark collects, uses, and protects your personal information when you use our services.
1. Information We Collect
We may collect personal information such as your name, email address, phone number, and business details when you use DaySpark software. We may also collect usage data, cookies, and other tracking technologies.
2. How We Use Your Information
We may use your information to provide and improve our software, communicate with you, customize your experience, and analyze usage patterns. We may also use your information to comply with legal obligations or protect our rights.
3. Lawful Basis for Processing
We will only process your personal information when we have a lawful basis to do so, such as when you have provided consent, when it is necessary to fulfill a contract, or when we have a legitimate interest in processing your information.
4. Information Sharing
We do not sell, trade, or otherwise transfer your personal information to third parties without your consent, except as required by law or as necessary to provide our services. We may share your information with service providers or business partners who assist us in operating our software.
5. Data Transfers
If you are located outside of the European Economic Area (EEA), your information may be transferred to and processed in countries that do not have the same data protection laws as your jurisdiction. By using DaySpark software, you consent to such transfers.
6. Data Retention
We will retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. We will delete or anonymize your information when it is no longer needed.
7. Your Rights
You have the right to access, update, or delete your personal information. You also have the right to object to processing, restrict processing, or request data portability. You can exercise these rights by contacting us at
8. Marketing Communications
We may use your personal information to send you promotional materials or newsletters. This does not apply to transactional SMS appointment reminders you opted into separately; those are covered in Section 9. You may opt out of receiving marketing communications at any time by following the unsubscribe instructions provided in the communication or by contacting us directly.
9. SMS Appointment Reminders
When you or your clients opt in to receive SMS appointment reminders from us or from a business that uses DaySpark, we collect the recipient’s mobile phone number, opt-in and messaging preferences, and the information needed to send each message (for example, appointment date and time, business name, and other details the sender includes in the reminder).
We use this information only to send and support the appointment-related text messages you agreed to receive, including delivery, logging for security and compliance, and responding to commands such as STOP and HELP. We do not sell or rent your phone number, and we do not share it with third parties for their own marketing purposes.
We may disclose limited information to messaging service providers (for example, carriers and SMS gateway vendors) strictly so they can transmit messages on our behalf. Those providers are contractually restricted from using your information for purposes other than providing the messaging service.
Phone numbers and related data collected for SMS appointment reminders are not used to send you promotional or marketing messages unless you have separately agreed to receive marketing from us or from the sender in accordance with applicable law.
10. Cookies
We may use cookies and similar technologies to track user activity and enhance your experience on DaySpark software. You can manage your cookie preferences through your browser settings.
11. Children's Privacy
DaySpark software is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under the age of 13. If you believe that we have inadvertently collected information from a child under 13, please contact us immediately.
12. Changes to Privacy Policy
